Explore the state and federal protections of employees’ privacy interests.  Both the Health Insurance Portability and Accountability Act (HIPAA) and the Americans with Disabilities Act (ADA), as well as state law, protect the privacy of information in employees’ records.  In addition, employees’ interest in their privacy while at work must be balanced against an employer’s need to supervise work and to investigate allegations of misconduct, including an obligation to address harassment claims.  Such supervision and investigation must be conducted within the confines of federal and state laws protecting privacy, including the Electronic Communications Privacy Act and the Employee Polygraph Protection Act.  Employers may also wish to test employees for use of drugs, while still considering their employees’ interest in privacy.  This on-demand webinar will guide employers in the collection and storage of information about their employees without violating their obligations to protect the privacy of those employees.

Explore the necessary characteristics of an arbitration program to resolve employment disputes.  As more employers turn to arbitration as an alternative to expensive and lengthy litigation, some agreements to arbitrate have not been enforced because they do not meet the minimum requirements to make the agreement to arbitrate conscionable.  In addition, if arbitration is intended to resolve statutory claims, courts look for certain standards in the program to ensure that employees are treated fairly.   If an employer’s arbitration program adheres to these standards, the employer may be able to resolve employment disputes without litigation.  Even if the employee still files a complaint, a solid arbitration program will be subject to only limited judicial review of the arbitrator’s decision.

Explore harassment in the workplace that could violate federal non-discrimination laws, including laws prohibiting sexual harassment and retaliation for engaging in protected activities.  To address harassment appropriately, an employer must be able to recognize it, so examples of what is and what isn’t illegal harassment are provided.  To avoid liability, employers must also know how to respond to harassing behavior, by either a supervisor or a coworker.  Specific steps for an effective investigation of harassment and suggestions for appropriate responses are provided.  Training is essential, and this on-demand webinar will give the tools to establish an effective training for supervisors and managers to address harassment and keep it from happening in the future.
